The Albuquerque Journal Editorial Board believes State Sen. Richard Martinez (D-Espanola) deserves more than five days in jail for his charge of aggravated driving while under the influence.

Martinez was sentenced earlier this month after he was convicted of driving drunk and slamming into a car that was stopped at a traffic light in his hometown in June. The individuals in the car he struck were injured, according to the editorial by the news agency.

The news agency doesn't agree that Martinez should continue to keep his Senate seat and be able to run for re-election after he showed no remorse for the accident. Many officials have called for his resignation, including Gov. Michelle Lujan Grisham.

The judge in the case said it was "by the grace of God" that Martinez did not kill any of the people who were involved in the accident, the news agency reported.

The news agency agrees that five days is more time than most receive for the same charges, but that because he caused serious injury, he should receive a harsher sentence.
